Covered Business Method

Like an IPR, a Covered Business Method Review, or CBM, is a petition-based proceeding at the PTAB. A CBM challenge evaluates patentability on grounds including §§ 101, 102, 103 and 112. Distinct from IPR, CBM proceedings are not subject to a one-year bar. To initiate a proceeding, however, a petitioner must be in litigation or under threat of litigation to have standing and the patent must be directed towards a covered business method.
